Why doesn't Companies take action on the millions of pirated/Cracked/Patched copies of Software?
These days Almost all softwares has its cracked/patched/pirated version available on internet.
Generally many of us are new user of thats all software so we unfamiliar with that all.
So we all feel uncomfortable in pay for these software.
So we decide to download Crack version of that software which is easily available.
Now few questions surely comes in your mind:-
All are Explained
READ CAREFULLY, YOUR ALL DOUBT WILL CLEAR.
√ Will the company take any action against you?
In all probability No! It is because generally the software companies take action not against the end user of the software but against the intermediary which is supplying the pirated software in the market. The intermediary in your case would be the website or the vendor which is selling/providing the pirated software.
Secondly the cost of taking action against you (filing a court case and the follow up proceedings) will be much more than what can be legally recovered from you. (I am presuming that yours is NOT a case of large scale commercial operations using the software in question.)
Thirdly the software companies take action against the end user if the pirated software is being used at a large scale. For example in India, we have a case where a computer graphics software company filed a case against the end user where the pirated software was being used in more than 15 computers and they were earning huge money by using that computer graphics software. So it can be said that in large scale commercial operations by an end user, a software company will initiate action.
Finally, I am revealing a trade secret of some software companies. Some of the software companies don't take much action against piracy because they want people to use their software and NOT shift to any other software. Imagine if Microsoft starts taking strict action against pirated Windows, eventually the people will start shifting to Google’s chrome operating system which Microsoft will never like. So the software companies in a limited way allow pirated software to a certain extent.
And now when you have already purchased a licensed copy, it is highly unlikely that the company shall take action against you. This is what they encourage people to do that is buying licensed software.
There is a conspiracy theory that the Photoshop crack was secretly released by its owned creator.
Do you know why?
It’s because they want all the students to use this software for free for all of their education time and do not bother to try any other alternative software of other competitors.
Then when the students finish their education, start to find a job and a company, now it’s the time for the company to buy a Photoshop license, since none of their employees can use any other software than the Photoshop itself.
That’s their marketing strategy.
√ Why companies Ask for legal license even they do not care Piracy or allow Pirated/cracked versions.
Jeff Raikes, head of the company's business group, said at a recent investor conference that while the company is against piracy, if you are going to pirate software, it hopes you pirate Microsoft software. He cited the above reasoning, noting that users of pirated Microsoft software are likely to purchase from the company later on. He said the company wants to push for legal licensing, but doesn't want to push so hard so as to destroy a valuable part of its user base
Let me give an example.
I grew up in typical Indian lower middle class family. I had not even seen a PC until I was in high school. We bought an assembled PC when I was in 9th grade. The total cost of PC was about 1.2 times the cost of Windows XP. If I had to buy all softwares, it would have costed me a lot more and my dad would not have bought the PC for few more years. But we learnt using the softwares (such as Windows XP, Adobe Photoshop etc.) by using the pirated copies. Next when I bought my laptop, I bought the one with genuine Windows 7. I also bought some antivirus too! (even though they were available for free). Just last month I switched job and my new company offered me a Mac-book . I refused because I had never used the Apple OS and was very unfamiliar with even navigation. They had to buy a windows laptop for me. Similarly with MS office. I’m very familiar with them and hence my company has to buy MS office.
Let’s see what would have happened if pirated/Cracked/Patched copies of MS-XP was not available.
I would have used Ubuntu/Red Hat/Fedora etc. basically a Linux.
I would have used Open Office .org or something similar.
I would have used some open source software equivalent to Photoshop.
All my purchases, the laptops then, current laptop and even my future PC’s would use Linux and open source software. So Microsoft loses a lot of future business.
If they had charged me for XP, they would have lost my business for 2-Windows 7, 2-Windows 10, 1- MS Office 2007, 2- MS Office 2010, 1- MS Office 360 and about 30+ years of future business to come. Not to mention the same from my sister.
That’s why Microsoft doesn’t mind if third world students/beginners use pirated versions, because this gives them a huge pool of possible customers for future business who are very familiar with their products.
As an another example of this concept... when I went to college, we had a university-wide site license for AutoCAD. While I was there, Autodesk decided to stop offering this, and charge individual licenses (academically discounted, but still orders of magnitude more expensive for the university)
Presumably, they thought that the university would just pay it.
Instead, they switched to a competitor product that was still willing to offer nice academic license terms.
The follow on effect of this is that now, instead of graduating tons of engineers who know and want to use AutoCAD in their professional lives, now they know and want the competitor's product.
And those commercial licenses made Autodesk WAY more money than the academic ones would have.
Microsoft did put many software things in place [like the updates] to make piracy harder. It also stepped up pressure on the governments to enforce copyright laws. I know of many small businesses in India buying legal copies as they fear raids. It is only on the consumer side it is very expensive to prosecute. They introduced starter packs to reduce the barriers to buy legitimate copies.
That said, Microsoft is not as hurt by students pirating Windows. It might even be helping them. If Microsoft made it impossible to buy pirated copies, some might use linux, some might use Mac and some might not buy a new PC for that year. All of those would hurt far more than losing potential revenues from that student.
Those "free" copies create a massive pool of Windows users that attracts the whole ecosystem of developers - creating a virtuous cycle. The massive body of Windows-comfortable consumers coming to the workplace makes Windows the default standard there.
In fact, the group that is usually the most angry with this pirating is Linux. Microsoft is in essence dumping free copies that takes away a huge share of Linux at the lower end of the spectrum. Sort of what Microsoft did to Netscape [by giving away free copies of Internet Explorer shipping automatically with Windows]. By being lax on piracy they get the job done [Windows for everyone] without even getting into any anti-trust trouble.
Back when we were in college, IBM used to woo us by providing free software [Websphere, DB2] and free training & certification - so that we are IBM ready for the workplace. My smart anti-Microsoft classmate [who now works for Google] would remark that while IBM has to spend money on DVDs and free training, Microsoft doesn't even have to spend on DVD cost and training, for the same outcome. The pirates do that job - helping Microsoft get something that other companies spend a lot of money on. Why should Microsoft be angry with that?
